By accessing or using our website, services, or materials (collectively, the "Services"), you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, you must discontinue using the Services immediately.

Commercial use is limited to transactions conducted on your own behalf.     8. The Services and their content, including trademarks, logos, and intellectual property, are owned by Golden Ocala and protected by applicable laws. All rights not expressly granted herein are reserved.

    9. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN OCALA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  9. Limitation of Liability

    10. IN NO EVENT SHALL GOLDEN OCALA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY IS TO STOP USING THE SERVICES.

  10. Changes to the Terms

    11. Golden Ocala reserves the right to modify these Terms of Use at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

  11. Governing Law

    12. These Terms of Use are governed by the laws of the State of Florida. All disputes shall be resolved exclusively in the state or federal courts located in Marion County, Florida.

  12. Miscellaneous

    13. If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in full effect. These Terms constitute the entire agreement between you and Golden Ocala regarding the Services.

  13. Membership-Specific Terms

    14. If you are a member of Golden Ocala Golf and Equestrian Club, these Terms of Use supplement the membership agreement, rules, and bylaws. In the event of a conflict between these Terms and your membership agreement, the terms of the membership agreement will govern. Membership-related disputes will also be resolved in accordance with the governing law and dispute resolution terms outlined in your membership agreement.

  14. Event and Booking Policies

    15. For events, tee times, facility reservations, or other bookings made through the Services:

    • Cancellations: Cancellations must be made at least 48 hours in advance, unless otherwise stated, to qualify for a refund.
    • Modifications: Changes to bookings are subject to availability and may incur additional fees.
    • No-Show Policy: Failure to appear for a reservation may result in forfeiture of the booking fee or deposit.

    Golden Ocala reserves the right to reschedule or cancel bookings due to unforeseen circumstances, in which case a full refund will be provided.

  15. User Conduct

    16. You agree not to engage in the following prohibited activities while using the Services:

    1. Harassment, abuse, or harm of other users or staff.
    2. Uploading or transmitting viruses, malware, or harmful code.
    3. Impersonating others or misrepresenting your identity.
    4. Attempting to gain unauthorized access to the Services or any associated systems.

    Violation of these conduct standards may result in suspension or termination of access to the Services.

  16. Health and Safety Disclaimer

    17. Activities at Golden Ocala, including golf, equestrian events, and other recreational activities, carry inherent risks. By using the facilities or participating in events, you acknowledge these risks and agree to release Golden Ocala from liability for injuries, accidents, or damage arising from such activities, except where caused by gross negligence or willful misconduct.

  17. Force Majeure

    18. Golden Ocala will not be liable for any delay or failure to perform due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, power outages, or internet failures.

  18. Digital Marketing and Communication Consent

    19. By providing your contact information, you consent to receiving promotional communications from Golden Ocala, including newsletters, special offers, and event updates. You may opt-out of these communications at any time by following the instructions in the email or contacting us directly.

  19. Children’s Online Privacy

    20. The Services are intended for individuals aged 18 or older. Golden Ocala does not knowingly collect personal information from children under the age of 13. If you believe we have collected such information, please contact us immediately at [email protected] to request its removal.

  21. Dispute Resolution

    22. For any dispute arising from or related to these Terms or the Services, you agree to attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved by binding arbitration conducted in Marion County, Florida, in accordance with the rules of the American Arbitration Association. Arbitration costs will be shared equally by both parties.

  22. Indemnification

    23. You agree to indemnify, defend, and hold harmless Golden Ocala, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the Services or your breach of these Terms of Use.
